Welcome new PEF members! We are pleased to report that the State is retroactively transferring approximately 250 employees to PEF’s bargaining unit.
As you may recall, in March 2013, PEF entered into an agreement with the State to transfer 250 M/C designated employees into PEF’s bargaining unit. Shortly after that agreement and the PERB decision effectuating it, the State reneged. It challenged these employees’ transfer for years. Those challenges are finally over.
The State is now implementing the employees’ transfer to the PS&T Unit. GOER has directed Civil Service and the Comptroller’s Office to implement retroactive placement of 250 M/C designated employees into PEF’s bargaining unit. Based on correspondence and conversations with GOER, it is our understanding that the following actions will now occur:
- Those individuals who were listed in the original March 27, 2013 decision, who are still in the at-issue positions, will be moved to PEF retroactive to March 27, 2013. They will receive compensation retroactive to March 27, 2013.
- Those individuals who were listed in the original March 27, 2013 decision, but subsequently left the positions, will receive prorated retroactive pay.
Please note that those individuals who were not listed in the original March 27, 2013 decision, but were hired, promoted or transferred into the positions after March 27, 2013, will not be transferred or receive retroactive pay. Only those M/C employees who were in the positions moved to PEF on March 27, 2013 are covered by the decision. Any M/C employee who was appointed to one of the positions involved after March 27, 2013 is not covered by the decision.
Effected individuals should receive a letter from their agency, transferring their position to the PS&T bargaining unit, within the next few weeks. Retroactive payments will take longer because the Comptroller’s Office has to manually calculate them. We anticipate it will take OSC several months to complete the calculations. We will continue to press the State to make all transfers and payments as quickly as possible.
