OTDA L/M meeting on January 29, 2008, Management promised to provide
an update on the issue regarding the legal authority to use Peace
Officers at 14 Boerum Place. PEF is requesting that Management
provide this update. PEF is especially interested in Management's
efforts concerning an alliance with Department of Health and HRA
(two agencies who are statutorily permitted to have Peace Officers)
in order to accomplish this goal. |

Management is finalizing an agreement with HRA to provide two Peace Officers as additional security at 14 Boerum Place. In addition, the surveillance system is being upgraded and added to the hearing rooms. Hearing room cameras will be activated only when panic buttons are pushed. Security procedures are being reviewed and updated and training will be provided to the security force. We anticipate 3-4 months to complete installation.

Monroe County DSS has changed security procedures due to an incident involving 2 clients in May 2008 (Rochester- St. Paul office). The original doors were a 2-door entrance way. As a result of the incident the door system is now only accessible by ID card swipe. Additional security measures are being investigated now.
Security reviewed at Endicott (16 camera surveillance system) and is deemed appropriate and acceptable by Management. Management will be meeting with DOL and SIF (other tenants in Building 16) to discuss security guards in the lobby. PEF has ongoing concerns that Management is not fully addressing the security issues at Endicott. Management will reach out to the other tenants in the building to approach security as a building-wide issue and explore feasibility of incorporating security into the leases. Management to report on the security guard protocol when there is only 1 security guard on duty.

At the last OTDA L/M meeting on January 29, 2008, G-25 Attorneys at OLA asked about promotional opportunities to the Associate Attorney G-28 position. Since the meeting, PEF's information is that several vacancies for the Associate Attorney (G-28) position at OLA have been announced. Hearing Officers from OAH who applied were told they were not eligible for the transfer, although Hearing Officers at OAH and Attorneys at OLA were hired off the same Legal Specialties List. PEF is requesting an explanation from Management as to why, although all attorneys were hired off the same list, some are being treated differently and are being fast-tracked for 3-grade promotions while the Agency is refusing to grant the same opportunities to attorneys at OAH.

Labor Service Representatives, now Welfare to Work members (Jobs Program Specialists), are increasingly feeling disadvantaged by their transition to OTDA. Opportunities for promotion are not attainable. Welfare to Work members do not qualify for supervisor position and feel that there is no career ladder for them. Grade 18’s in OTDA are also requesting equity in applying for job titles in DOL. DOL titles are eligible or qualified for OTDA titles but not vice versa. PEF ask for HR to re-review. |

York City ALJs have 32 cases regularly scheduled on their daily
calendars while ALJs elsewhere in the State have 20 scheduled cases.
Management justifies the scheduling of an additional 12 cases daily
on calendars heard by New York City ALJs by stating the NYC ALJs may
use checklist decisions not available to upstate and Long Island
ALJs. Since Management has announced its intention to eliminate the
checklist decisions, when will the calendars be reduced for New York
City ALJs to bring them into line with the rest of the State?

Administrative Hearings offers overtime for current employees and
employees from other departments. There is an overtime policy for
inside workers and a policy for outside workers. The policy states
that an employee may not charge accruals on the day scheduled for
overtime, without prior approval. The outside policy is difficult to
enforce as supervisors are not aware of the outside employees time
