                                 Special Executive Board Meeting

                                         January 10, 2006

                              Desmond Hotel, Albany, New York

 

 

President Benson called the Special Executive Board meeting to order at 11:10 a.m., Tuesday, January 10, 2006.  Members joined in the Pledge of Allegiance to the Flag.

 

Robert Montalbano representing OMRDD was sworn in at this meeting.

 

ADOPTION OF THE AGENDA

Wayne Bayer moved to amend the agenda to include discussion on the Civil Service change in promotional battery test and the expiration requirements.  There was a second to the motion and the agenda was amended to include this item.  The agenda as amended was adopted as follows:

 

  1. Call the Meeting to Order
  2. Pledge of Allegiance to the Flag
  3. Swear in Newly Elected Board Members
  4. Consideration of Tentative Oswego County Collective

                 Bargaining Agreement

  1. Discussion on the Civil Service Change in Promotional Battery Test

 

President Benson gave his remarks on the necessity to call a Special Board Meeting due to the potentially controversial concession that could impact other PEF unit negotiations.

 

Director of Labor Relations, Roger Scales provided details regarding the actual negotiating process and the roll of staff and the substance of the contract.

 

PEF Division 512 Council Leader, Linda Nagel explained her negotiation strategy.

 

At this time there was a question and answer period regarding the negotiating process.

 

Charlie Kelefant moved to end the question and answer period and go into Executive Session for debate.  There was a second to the motion and it was defeated.

Question and answer period continued.

 

Recess for 20 minutes for boxed lunches to be brought into the meeting room.

 

President Benson called the meeting back to order and  stated we were still doing the questions and answers and then it would be in order to entertain a motion to approve the tentative collective bargaining agreement and sent it to the members for a vote.

 

Questions and answers continued for some time.

 

Joe Lewis moved to accept the contract of the Oswego County Division of PEF and to send it to their members for a vote.  There was a second to the motion.

 

Debate ensued and the question was called.  Secretary-Treasurer moved for a roll call vote, received a second and the motion carried.  The vote to send out to the contract to Oswego County was defeated 57 no and 28 yes.

 

A motion was made that PEF hold the members of Division 512 harmless from any attempt by the County of Oswego to obtain reimbursement for the payment already made under the now disapproved tentative agreement through a series of interest free loans, pending the resolution of the contract.

 

President Benson ruled the motion out of order as PEF has a policy against making loans to PEF members.  There was an appealing of the chair and the chair was sustained.

 

Vice President Fox moved that Board recommend that PEF explore filing an improper practice against Oswego County and to seek as a remedy $2000 per member.  The motion received a second, and after debate it was adopted.

 

President Benson answered a question from Ed Lucas regarding the rumor of a retirement incentive.

 

Discussion on the Civil Service Change in Promotional Battery Test

Tom Cetrino, Director of Civil Service Reform explained the changes and answered questions from the Board members.

 

A motion was made, seconded and carried to adjourn.
