Attendance and Leave

(NOTE: The Accrual Rates Listed Here Apply to PEF Members who are Full-time, 12 month Employees Covered by The NYS Department of Civil Service Attendance Rules)

 

Special Note on Using the Department of Civil Service Attendance and Leave Manual. 

Most of the links are to the main provisions of the Attendance and Leave Manual, but very often you must check the linked "Contract Pages" to fully understand the provisions. Wherever possible, we have tried to include links directly to these additional materials.

Importantly, some of the "Contract Pages" have not been updated to reflect recent Contracts.  Instead, the contractual changes are detailed in separate implementation memos. 

Be sure to check each of these implementation memos that followed ratification of the PEF Contract:

Vacation (Annual Leave)

13-20 Days Per Year

(not Including Additional Vacation Credit Starting after 20 years of service)

Special Note: The Contract Pages still include a reference to the phase-in of Bonus Vacation Day credits for the first 2 years of employment.  This provision was eliminated in 1995 and employees (except institution teachers) earn 1 and 2 bonus vacation days following their first and second year of employment.  See the 1995-1999 PEF Implementation Memo for more details.

 

 

Sick Leave

Productivity Enhancement Program (PEP)

The Productivity Enhancement Program allows certain employees SG-17 and Below to Exchange Annual or Personal Leave for a Credit toward their share of their Health Insurance Premium.

Institution Teachers

10 Month Employees are not covered by the Department of Civil Service Attendance Rules.  Instead, each agency using 10 month employees has adopted their own attendance rules.

Family and Medical Leave Act
 (FMLA)

 

FMLA regulations revised

This Federal Law provides benefits that in addition to those provided by the Contract and by the Attendance Rules.  Although FMLA is unpaid leave, the Federal Law provides additional entitlement to time of for:

  • Leave for foster care placement.
  • Health insurance coverage at employee share cost during
    periods of FMLA leave without pay.
  • Mandatory leave for certain absences in connection with family illness

Since employees also have the option to use their leave credits for FMLA qualified absences, there are specific policies that govern the intersection of FMLA benefits and Attendance Rules Coverage.  Check this Appendix for more information,
