Consumer Protection Board

 

The Executive Budget recommends (analysis as of January 30, 2004):

 

·         An FTE level of 29, unchanged from the adjusted 3/31/04 FTE level in the SFY2004-05 Executive Budget.  However, the adjusted 2003-04 level is 1 FTE less than anticipated in the SFY2003-04 Executive Budget The 1 FTE eliminated in SFY2003-04 was funded by a General Fund appropriation.

·         An All Funds appropriation of $3,408.000, a $1,590,000 decrease from the enacted SFY2003-04 All Funds appropriation.  This decrease is almost entirely in the Telemarketing Registry SRO appropriation.  According to the Executive Budget and the Assembly Ways and Means committee, this decrease is due to the transfer of the Do Not Call Registry to the Federal Trade Commission in August 2003. According to the Assembly Ways and Means committee, however, the complete savings from this transfer is $1,721,000 and $300,000 is available for activities related to the Board's implementation of the Motor Fuel Marketing Practices Act.

·        The Executive proposes Article VII legislation to:

-         Increase the penalty for violations of New York State's No Telemarketing Sales Call Law to conform to the Federal penalty, which will generate $100,000 in new revenue necessary to implement the SFY2004-05 budget.

-         Authorize the CPB to recover costs incurred while investigating complaints pertaining to the Motor Fuel Practices Act which will generate $160,000 necessary to cover the cost of the Board’s Motor Fuel program

-         Increase from $500 to $5,000 the maximum civil penalty for unfair and deceptive business practices, which will generate $500,000 in new revenue necessary to implement the SFY2004-05 budget.
