The Executive Budget recommends (analysis as of January 28, 2004):
· A FTE level of 524 or a decrease of 17 positions. However, the current FTE level is 25 more than was anticipated in the SFY 2003-04 budget as the FTE levels in Agriculture Business Services Program (General Fund) grew by 17 and the Consumer Food Services Program (General Fund) grew by 8 positions.
· A $3.6 million (3.4%) increase in the Department’s All Funds appropriation. However, $2,500,000 of this is due to an anticipated increase in additional Federal grants from the Farm Bill and from the United States Department of Agriculture. $2 million of which is in an increased Miscellaneous Operating Grants appropriation for the Agriculture Business Services Program and $500,000 of which is in increased appropriations for the Health and Human Services and Consumer Food services accounts within the Consumer Food Services program.
· A decrease in the FTE level in the Consumer Food Services Program (General Fund) of 19 positions and a corresponding $800,000 decrease in personal service appropriations. There is also an increase of 2 FTEs in the Agriculture Business Services Program (General Fund). This program’s personal services appropriation increases by $1.4 million, which does not correspond with a 2 FTE increase. This discrepancy should be raised with Agriculture and Markets (A&M) management.
· Legislation to establish a program of risk- based inspections of retail food stores, replacing the current annual inspection program. The proposal is expected to result in $1,100,000 in General Fund savings. This could be the reason for the 19 FTE reduction proposed for the Consumer Food services program. This issue should be clarified with A&M management. In addition, the Executive recommends amending the Agriculture and Markets Law to eliminate the annual inspection of pet dealers and breeders and establish a risk- based inspection pet dealer and breeder program, using criteria developed by the Commissioner. Under current law, the Department inspects pet dealers once a year. The Executive recommends an appropriation decrease of $300,000 because General Fund savings are expected to result from the measure.
· Legislation to establish a new biennial license fee of $100 on currently unregistered or unlicensed food establishments. It is anticipated that this fee will generate $381,000 in revenue.
