The enacted budget (May 16, 2002) makes no changes to the Executive Budget.

 

The Executive Budget recommends (analysis as of February 1, 2002):

 

·        An FTE level of 924 which is unchanged from the SFY 2001-02 FTE workforce.

·        An increase of $3.723 million in the non-personal services appropriation in the Administration program.  This funding is to finance the relocation of the Department’s Albany office from Agency Building One in the Empire State Plaza to One Commerce Plaza.  Last year the agency requested $2 million for this purpose and it was not included in the budget enacted by the Legislature. 

·        An increase of $2.354 million in the personal services appropriation for the Consumer Services program.  It is unclear what this increase reflects since Appendix 1 of the Executive Budget shows the same appropriation of $7,620,000 for personal services but only shows this to be a $196,000 increase over last year’s personal service appropriation.  However, the SFY 2001-02 appropriation bill for the department only shows a $5,266,000 appropriation for personal service. This inconsistency should be discussed with agency management.

·        An increase of $2.129 million in the Maintenance Undistributed appropriation in the Regulation program.  $4.4509 million of this appropriation is for suballocation to the Department of Law for services and expenses associated with the implementation of Executive Order 109, which appoints the Attorney General as special prosecutor for no-fault auto insurance fraud.  This program accounts for most of the increase in the Maintenance Undistributed appropriation for this program.  In addition, the Executive recommends a deficiency appropriation of $3 million for SFY 2001-02 for suballocation to the Department of Law for costs associated with this same Executive Order.

·        A suballocation of $1,070,000 from the Maintenance Undistributed appropriation in the Regulation program to other State agencies for services and expenses to develop and promulgate fire safety standards for cigarettes.  This represents a decrease of $4.5 million from the SFY 2001-02 suballocation.
