The budget enacted by the Legislature makes the following change to the Executive Budget (analysis as of May 22, 2002):

Eliminates the New York Institute for Cultural Education (NYICE) which was funded with a $26 million appropriation. The programs proposed for the Institute remain in the State Education Department. The filing fee increase dedicated to a cultural education account as proposed by the Governor is also approved (see Part B of S6258-B/A9760-B).

The Executive Budget recommends (analysis as of January 29, 2002):

An FTE level of 55; this is an overall reduction of 8 positions from the Governor’s proposed 63 FTE level in the SFY 2001-02 Executive Budget. 6 of the FTE reductions will occur by 3/31/02; all of the reductions will be General Fund positions. The additional 2 positions reduction for SFY 2002-03 that the Governor is proposing will also be General Fund positions.
The creation of a new public benefit corporation, the New York Institute for Cultural Education (NYICE). The State Education Department’s Cultural Education program would be moved into the new corporation. The move is proposed for July 1, 2002. The new corporation will be funded by increasing the filing fee charged by county clerks. No changes in staffing are proposed. However, the new corporation will have a Merit Board to oversee the “civil service” system for the corporation. While its employees would remain State employees, the titles and salary grades would not be set by the NYS Department of Civil Service Division of Classification and Compensation.
A cut of $30,000 (-0.9 percent) in the General Fund personal services appropriation. It is not clear how contractual increases of 3.5 percent can be accomplished with the reduction of 2 positions and result in a less than one percent reduction in personal services.
An additional $380,000 (23.9 percent) in the General Fund nonpersonal service appropriation. This appropriation was increased by $380,000 during SFY 2001-02 through a transfer from the Education Department. This transfer in essence restored a cut in the non-personal service appropriation made by the Legislature from the Executive Budget’s proposed non-personal service appropriation for SFY 2001-02.
