Albany – PEF learned today that the Public Employment Relations Board (PERB) granted a favorable decision to the union in a case against the state Office of Temporary and Disability Assistance (OTDA).
In September, 2014, PEF filed an improper practice charge alleging that OTDA violated the Public Employees’ Fair Employment Act by refusing to provide records which PEF requested. PEF argued that the refusal interfered with the rights of public employees. The case revolves around one OTDA employee, Usher Pillar, a PEF union representative, who requested a copy of his internal investigation report which OTDA compiled. PERB agreed that PEF’s need to evaluate the report to consider the merits of filing for arbitration outweighs OTDA’s interest in maintaining confidentiality.
